<p>Within the United States, the term &#8220;state law&#8221; refers to the law or rules of each separate United State. In New Jersey as with other states, these state laws are passed by the state legislature. They are then signed into code by the New Jersey state Governor. New Jersey state laws, like any other state laws, often conflict with the United States federal law. When there is an unclear interpretation of state law, the issue or conflict is resolved by the federal courts.</p>
<p>New Jersey state laws follow the state constitution. In the United States, every separate state has its own separate constitution of state laws. A constitution is made up of a governmental set of rules. Like statutes, New Jersey&#8217;s state constitution is codified as a written legal document. The constitution operates under its own distinct political agenda and existence.</p>
<p>There are state laws that regulate everything from driving to property to taxes. State laws may differ from state to state, although crimes of a violent nature usually carry similar penalties in every state in America. There are some state laws in New Jersey that don&#8217;t exist in other states.</p>
<p>-One unusual New Jersey state law declares that it is illegal to wear a bullet proof vest while committing a murder.</p>
<p>-In New Jersey, state laws disallows drivers from operating their own gas pumps. Under this state law, gas pumps must be operated by the individuals working at the gas station. Oregon is the only other state who requires this to be a state law. Insurance costs for gas stations are lowered if the gas station only has professional employees operating the gas pumps.</p>
<p>-Another state law in New Jersey designates the month of May as &#8220;kindness awareness month in New Jersey.&#8221; New Jersey citizens are urged to participate in kindness educational programs and try to inspire kindness in one another.</p>
<p>-In New Jersey, state law prohibits car dealerships from operating on Sundays. Legally, operating a car dealership on Sundays in New Jersey breaks state law by committing a disorderly persons offense.</p>
<p>-State laws in New Jersey make it illegal to delay or detain a homing pigeon.</p>
<p>-Any individual or business selling hand cuffs to minors is breaking a New Jersey state law.</p>
<p>-If an individual is found guilty of Driving While Intoxicated (DWI) or Driving Under the Influence (DUI) than New Jersey state law makes it illegal for that person to ever again apply for a personalized license plate.</p>
<p>-In New Jersey, state laws rules that one must relinquish a phone line to an individual if it is an emergency. A individual is said to be guilty of a disorderly persons offense when, being informed that a party line is needed for an emergency call, refuses to immediately relinquish the particular phone line.</p>
<p>-When selling spray paint, a business or establishment must have a nearby sign posted informing minors of legal action that may be taken against them if they deface public property with graffiti.</p>
<p>While some state laws are unusual, in general, they serve their purpose by allowing a state to have legal rules that every individual must follow.</p>

<p>In New Jersey, the child support program is supervised by the state Department of Human Services, Division of Family Development, Office of Child Support Services. Each individual NJ child support case is administered in individual counties, depending upon the residence of the parents.</p>
<p>-Every child support case involves two parents. One is the custodial parent. This is the parent who lives with the child and has the main day-to-day responsibility. The other parent is referred to the non-custodial parent. Statistically, the non-custodial parent in the child support case is the father: 90% of the time.</p>
<p>-Embarking on a NJ child support case involves dealing with a series of different county offices.</p>
<p>-There are three county offices that handle all NJ child support cases. These three offices are the county Boards of Social Services, the county Family Courts, and the county Probation Division.</p>
<p>-The county Boards of Social Services is also known as the welfare agencies. They handle NJ child support cases. The agencies work together to find the non-custodial parent of the child if that parent cannot be located. The county Boards of Social Services are also responsible for establishing paternity and filing court complaints for both paternity and child support. In addition to these services, they also     help low-income custodial parents receive access to all welfare, Medicaid, child care and employment services.</p>
<p>-The county Family Courts are in charge of scheduling, conducting, recording, and keeping track of any court hearings in a NJ child support case. This includes but is not limited to any custody issues and visitation schedules that the parents will need to establish with each other.</p>
<p>-The last county office is the county Probation Divisions. This is the branch that is in charge of monitoring and money due and paid in a child support case. They are also in charge of making sure that any child support due is paid on time. If child support payments are not made on time, they are in charge if of collecting it through various enforcement efforts. This may include garnishing the non-custodial parent&#8217;s wages and tax refunds if necessary.</p>
<p>-Both the Family Court and Probation Divisions are headed by the NJ Administrative Office of the Courts.</p>
<p>NJ child support agencies are committed to the idea that it is each parent&#8217;s responsibility to make sure that their child has food, shelter and clothing. Because many children do not get the joint support that they are entitled to, NJ child support laws have been put into affect to maximize the possibility of each child getting what is necessary from each parent.</p>
<p>It is the job of both the mother and the father to make sure that their child is getting not only physical and financial child support, but emotional support as well, regardless of their current relationship with each other. Child support is not a privilege, it is a right. NJ child support programs are dedicated to helping the children of New Jersey. They also provide help for the parent&#8217;s of those children if the custodial parent is not getting child support or cooperation from the non-custodial parent.</p>

<p>There are plenty of legal issues and disputes that are never brought to New Jersey courts. However, in New Jersey courts alone, there are about seven million new cases that are filed on a yearly basis. In those particular cases, judges in the NJ courts are required to settle disputes involving many topics such as criminal law, motor vehicle violations, divorce, custody and other family matters. New Jersey courts also handle wills, trusts, estates and contracts. People set the agenda for New Jersey Courts through these such cases. Courts are the most noticeable part of America&#8217;s legal system.</p>
<p>-The organization of New Jersey courts system is one of the simplest in the United States. In New Jersey, there are several different kinds of courts. They include the New Jersey Supreme Court, the Superior Court (this includes Appellate Division) the Tax Court, and the Municipal Courts.</p>
<p>-The court system, or Judiciary, is one of the three co-equal but independent branches of state government established in New Jersey. The other two branches are the Executive Branch and the Legislative Branch.</p>
<p>-Any NJ courts case involving criminal, civil and family matters are handled in the Superior Court. The Superior Court is also known as the trial court, because it is the court where trials are conducted. There is a different Superior Court in every county in New Jersey; there are 21 different counties. In New Jersey, there are roughly 360 Supreme Court Trial judges.</p>
<p>-In Tax Court, the judges are in charge of reviewing the decisions of county boards of taxation. The NJ courts are in charge of deciding how much a particular property should be taxed. Tax Court judges are also responsible for examining the decisions of the State Division of Taxation on a variety of matters. These matters include anything involving state income tax, sales tax and business tax. In New Jersey courts, there are 12 Tax court judges.</p>
<p>-When people do not agree with the outcome of their cases in the trial court or Tax Court, they have the option to appeal their case to a higher court. These higher New Jersey courts are known as appellate courts. Appellate courts are in charge of examining the decisions of the lower NJ courts to determine whether those decisions were right under the law.</p>
<p>-If either the plaintiff or the defendant is unhappy with the outcome in the Appellate Division, they have the right to appeal the case to the New Jersey Supreme Court. The Supreme Court is the highest of New Jersey courts. The Supreme Court is responsible for reviewing the decisions of other NJ courts. The Supreme Court, not unlike the Appellate court, tries to understand any laws that are unclear, hard to understand, or are contradictions of other laws.</p>
<p>-The last of the New Jersey courts is the Municipal Courts. Roughly six of the seven million cases filed in New Jersey courts each year are filed in the Municipal Courts. The Municipal Courts hear a vast variety of different types of cases. Municipal Court is where cases involving motor-vehicles offenses are tried. These include everything from parking tickets to drunk driving charges.</p>
<p>Municipal Courts also hear cases that involve such criminal offenses as simple assault and shoplifting. In New Jersey, there are 539 Municipal Courts.</p>

<p>The NJ legislature is the legislative branch of the government of the United State of New Jersey. As defined by the New Jersey Constitution of 1947, which is the most recent update, the NJ Legislature consists of both the General Assembly and Senate. The meeting headquarters for the NJ legislature is located in the capital, Trenton, in the New Jersey State House.</p>
<p>The New Jersey judiciary an independent branch of government. The New Jersey judiciary is in charge of making sure there is a fair and reasonable resolution of political disagreements in order to protect the rights and liberties promised by the Constitution and in the laws of the United States, specifically in New Jersey.</p>
<p>-The NJ legislature is able to decree laws by a majority vote of both the General Assembly and the Senate, subject to the New Jersey Governor&#8217;s power to veto a particular bill. A veto may be overruled by the NJ Legislature if there is a two-thirds majority in favor of overruling in both the General Assembly and the Senate.The New Jersey judiciary branch is required to interpret and explain the possible law         that is being proposed to go into effect.</p>
<p>-The NJ legislature may suggest an amendment to the State Constitution if three-fifths of both the General Assembly and the Senate agree.</p>
<p>-Alternatively, the NJ legislature may propose an amendment by a majority vote of at least two consecutive years. Either way, the referendum, which is a legislative act that is referred for final approval to a     popular vote by the electorate, is added to the ballot. If approved, it becomes a valid part of the United States Constitution.</p>
<p>-The NJ legislature can sanction amendments to the U.S. Constitution.</p>
<p>-The NJ legislature can also appoint the State Auditor, assess the elections and qualifications of its members.</p>

<p>There is only one scientific way to determine if a driver is under the influence of alcohol and drugs an it is through blood alcohol concentration (BAC). A person&#8217;s blood alcohol concentration is tested with a Breathalyzer test. In the state of New Jersey, as with all other states, a person with a blood alcohol concentration of 0.08% or greater who operates a motor vehicle or a boat is considered to be driving under the influence (DUI). A person&#8217;s blood alcohol concentration refers to the amount of alcohol present in their blood stream and is measured in percentages. It depends on the amount of alcohol consummed and the body weight of an individual.</p>
<p>-Being convicted of a New Jersey DUI is an extremely serious offense that may carry heavy punishments. Possible consequences include paying fines and surcharges, serving jail time, or community service. NJ DUI punishments vary depending on the number of previous offenses and the actual blood alcohol concentration of the person operating the vehicle.</p>
<p>-A NJ DUI with a BAC of .08 to .10 will result in the individual losing his or her motor vehicle license for at least three months. Additional penalties for a New Jersey DUI besides fines could include a 30 day or less jail sentence, and 12 to 48 hours of community service.</p>
<p>-A New Jersey DUI with a BAC of .10 or higher will result in the individual losing his or her license for a minimum of seven to 10 months and carry a jail sentence of up to 30 days and community service of 12 to 48 hours.</p>
<p>Obviously, a New Jersey DUI becomes more serious if there have been previous NJ DUI offenses on a person&#8217;s record.</p>
<p>-If a person receives two NJ DUI within a ten year time period, they will lose their license for a minimum of two years. Any person who is convicted of a New Jersey DUI will also be at risk for a jail sentence ranging anywhere from 48 hours to 90 days and 30 days of community service.</p>
<p>-If a person is convicted of three New Jersey DUI within ten years, they will lose their license for a minimum of ten years. They can also be jailed for up to 180 days and 90 days of community service.</p>
<p>Failure to pay any fines or surcharges of a NJ DUI conviction will result in an indefinite suspension of driving privileges,</p>
<p>After a New Jersey DUI arrest, one is usually required to go to court for arraignment, negotiated disposition, and sentencing. Most NJ DUI cases are misdemeanors when no one is injured. A New Jersey DUI can be considered a felony in cases when serious injury or death occur.</p>

<p>A statute is a written enactment of a primary legislative authority that governs a state, a city, or a county. New Jersey statutes govern New Jersey only and have no power over any other state in America. Usually, statutes are created to enforce or ban something. New Jersey statutes are also used to declare political polices in New Jersey. The word statute is generally used to distinguish any laws that are created the legislative branch of the New Jersey law system, differentiating from specific case laws issued by New Jersey government agencies. Because of this, New Jersey statutes are sometimes referred to as legislation. New Jersey statutes are considered to have primary authority, as opposed to secondary authority, in New Jersey law. This mean that New jersey statutes are the highest law in any New Jersey law.</p>
<p>In the United States, a state law refers to the laws or legal rules of each separate United State. In New Jersey, these laws are passed by the state legislator and approved by the New Jersey state Governor.</p>
<p>-In some countries, before a statute can become a law it must be agreed upon by the highest executive in the existing government. In that instance, if the statute is agreed upon by the highest executive in the government, then it can be published as part of a code.</p>
<p>-The New Jersey statutes that define the New Jersey law are arranged by codes. Each code refers to the New Jersey law of a particular subject. These subjects are very specific and thoroughly describe the consequences and rules of any act when one is dealing with New Jersey law. Some of the topics that these New Jersey statues may cover deal with everything from education to insurance to property ownership.</p>
<p>-New Jersey statues also cover a wide variety of fields ranging from alcoholic beverages to criminal New Jersey statutes to land use matter, from zoning ands housing matters.</p>
<p>-The New Jersey statutes are generally interpreted in light of the legislative notes that accompany the enacting legislation. In this way, the New Jersey courts may try to look to debate an argument in enacting the New Jersey statutes to offer some measure of interpretation.</p>
<p>-Unless the issue is black and white, the language of the New Jersey statutes are subject to different interpretations, some of which may depend on the social circumstances of the particular moment in question.</p>
<p>-New Jersey law in many respects can be the same as the law of other states. However each state is left in charge of interpreting its own police power as well as being subordinate to federal law in areas that settle a particular jurisdiction. An example of this would be like interstate commerce control.</p>
<p>-Another example may be the death penalty. While New Jersey statues may prevent the death penalty for criminal that would get the death penalty in another state, that New Jersey law may still be required to be balanced by protections of federal law.
